Morocco: PPP and investment law

The laws that govern PPP and concessions, investment guarantees, dispute settlement and legal terms, with links to the official texts.

In brief

Morocco regulates PPPs through Law No. 86-12 of 2014 on public-private partnership contracts, amended by Law No. 46-18 of 2020. A public body entrusts a private partner with a global mission: design, financing, construction or rehabilitation, maintenance and/or operation. The 2020 law extends the scope to the State, territorial collectivities, public establishments and State-owned enterprises, and creates the National PPP Commission, chaired by the Head of Government. Morocco is an ICSID Contracting State and a party to the New York Convention. The official sites could not be reached during our check, so we read the texts on archived copies from the SGG; later amendments to Law No. 46-18 have not been checked.

Extends the scope to the State, territorial collectivities and their groupings, public establishments and State-owned enterprises. The private partner is a legal entity under private law. Article 9 covers the unsolicited offer (offre spontanée: the idea holder, with a flat-rate premium). The law creates the National PPP Commission, chaired by the Head of Government, and a standing committee for territorial collectivities. Its Article 4 brings it into force on publication of its implementing regulations, which we have not checked. The link leads to an archived copy (Web Archive) from the SGG site.
