In brief

Senegal regulates PPPs through Law No. 2021-23 of 2 March 2021 on public-private partnership contracts (Loi n° 2021-23). It covers all sectors except, among others, PPPs under the sector laws for energy, mining and licensed telecoms, defence and security, and in-house arrangements (quasi-régie). The competent body is the National PPP Support Unit (UNAPPP) under the Ministry of Economy, Finance and Planning. Senegal has been an ICSID Contracting State since 1967 and is a party to the New York Convention.

The PPP law in force; the UNAPPP lists it as the PPP law in 2026. Article 3 defines the autorité contractante, the titulaire, the opérateur économique and the offre d’initiative privée, as well as concession, affermage, régie intéressée and PPPs paid by the public body or by users. The law creates the UNAPPP. Article 57 repeals Law No. 2014-09 of 20 February 2014 and Law No. 2004-14 of 1 March 2004. The link leads to a scan of the Journal officiel hosted by the UNAPPP.
